Naming a guardian for your children can be done either through a will or by forming a trust. It is important to have this as part of your estate plan if you have minor children, because if you do not have either, the court will ultimately decide who becomes guardian for your children.

It depends on your family dynamics and the types of assets you have. For young married couples with small children and assets all in Maryland, a will may be fine for them. For blended families, families with LLCs or S corps, or families with assets in multiple states, a trust will likely be the best solution.

It is important to think of the different skill sets of those you are considering designating. The person who may be best suited to care for your children or make medical decisions, may not be the best person to designate to make financial desisions. Many times those skill sets do not coincide, and it is best to name different people to take care of different tasks. This helps ease the burden by sharing responsibilities, and maximizes the abilities of your loved ones to carry out your wishes.
